These Terms of Service ("Terms") govern access to and use of the websites, mobile applications, fantasy sports contests, commissioner services, content, and other products and services provided by RealTime Fantasy Sports, Inc. ("RTFS," "we," "us," or "our").

1. Acceptance of Terms

RealTime Fantasy Sports, Inc. provides fantasy sports services and content through RTSports.com, FantasyChampionship.com, FreeDraftGuide.com, and the RTFS full-season, daily fantasy sports ("DFS"), Pick'em, and all mobile applications.

By accessing or using an RTFS website, application, product, contest, or service (collectively, the "Services"), or by clicking to accept these Terms, you acknowledge that you have read, understood, and agree to be bound by these Terms and by the individual rules and scoring provisions applicable to each league or contest in which you participate.

If you do not agree to these Terms, you may not access or use the Services.

Players will be notified of changes to these Terms through an RTFS landing page.

2. Eligibility and Compliance with Law

Users may participate in RTFS Services only where such participation is permitted by applicable federal, state, and local laws and regulations.

RTFS may restrict access to particular contests, features, deposits, withdrawals, or other Services based upon age, identity, physical location, account status, or applicable legal or regulatory requirements.

Participation in public leagues in which prizes are awarded requires account verification as described in Section 4.

Persons under the age of 18 are prohibited from participating in any RTFS fantasy contest that includes an entry fee. Individual contests may impose additional age restrictions.

Nothing in these Terms authorizes participation in a contest where participation is prohibited by law or the Official Rules applicable to that contest.

3. Governing Requirements and Regulatory Compliance

RTFS operates its Services subject to applicable federal, state, and local laws and regulations.

Nothing in these Terms authorizes participation in an RTFS contest or use of an RTFS Service where such participation or use is prohibited by applicable law.

Individual jurisdictions may impose requirements that differ from or supplement these Terms, including requirements concerning participant eligibility, minimum age, physical location, deposits, withdrawals, responsible gaming, recordkeeping, disclosures, dispute procedures, and regulatory jurisdiction.

Where an applicable law, regulation, regulatory order, or mandatory jurisdiction-specific requirement conflicts with these Terms, the applicable legal or regulatory requirement shall control to the extent of the conflict.

4. Player Accounts and Verification

To participate in public full-season or DFS leagues in which prizes are awarded, a player's account must be verified to confirm the accuracy of the account holder's information.

Players consent to age and identity verification as a condition of participation in public leagues and consent to ongoing geolocation verification by RTFS.

To obtain verification, a player must accurately provide the player's legal name, permanent address, and date of birth. RTFS may verify this information through third-party services that access public and private databases. Players may be required to provide a partial or complete Social Security number to assist with verification.

Verified players agree that no person other than the account holder whose legal name appears on the account may access or use the account for any purpose.

Minors may not verify accounts or participate in public contests. Individual contest rules may establish additional age requirements.

Players may be required to re-verify their accounts following a change of permanent address.

A verified account is required to cash out.

Players are prohibited from:

  • allowing another individual to access or use their fantasy contest player account;
  • submitting a fantasy contest entry on behalf of another person;
  • using computer scripts other than authorized scripts;
  • using proxy servers, virtual private networks (VPNs), or other technology to misrepresent identity or location for purposes of entering or participating in fantasy contests; and
  • establishing or attempting to establish more than one username or fantasy contest player account, directly or through another person acting as a proxy.

All excess accounts belonging to an individual violating the multiple-account restriction may be terminated.

Players consent to the jurisdiction of their state for resolution of disputes arising from fantasy contest activity conducted under applicable fantasy sports laws, regulations, and rules.

5. Account and Password Security

Players are responsible for maintaining the confidentiality and security of their account credentials and activity occurring through their accounts.

Players are encouraged to select a password unique to RTFS and not used with other services.

Passwords must contain a minimum of eight characters and include at least one letter, one number, and one special character. Spaces are prohibited.

Passwords are subject to annual change requests or requirements. Players may not reuse their previous password and may not share their account or password with another person. Violations may result in account suspension.

Multiple failed login attempts will result in temporary account suspension.

Users should promptly notify RTFS if they know or reasonably suspect that account credentials have been compromised or unauthorized account access has occurred.

RTFS may temporarily restrict access to an account when reasonably necessary to investigate suspected unauthorized access, fraud, identity-verification issues, security incidents, violations of these Terms, or activity that may threaten RTFS, its customers, or contest integrity.

6. Contest Rules

Individual RTFS leagues, contests, games, and promotions may be governed by additional Official Rules, scoring rules, eligibility requirements, entry limits, prize structures, and other contest-specific provisions.

By entering a contest, a participant agrees to comply with these Terms and all rules applicable to that contest.

If a contest-specific provision directly conflicts with these Terms concerning the operation, scoring, eligibility, entry requirements, prizes, or settlement of that contest, the applicable Official Rules shall control with respect to that contest.

7. Commissioner Services

7.1 Full-Season Fantasy Football Commissioner Service

The service runs through March 1 of each year. At that time, the site will remain open, but league data, including message boards, transactions, trades, gamecasts, and standings, will be removed and leagues will be reset for the next season.

Some information may be archived; however, users are responsible for saving any information they wish to retain.

RTFS is not responsible for retaining data pertaining to any league.

7.2 Playoff Fantasy Football Commissioner Service

The service runs through March 1 of each year. At that time, the site will remain open, but league data, including message boards, transactions, trades, gamecasts, and standings, will be removed and leagues will be reset for the next season.

Some information may be archived; however, users are responsible for saving any information they wish to retain.

RTFS is not responsible for retaining data pertaining to any league.

8. Full-Season Public Fantasy Leagues

Fantasy football leagues run through March 1. At that time, leagues and their contents will be removed from the site and registration will begin for the next season.

Fantasy baseball leagues run through December 1. At that time, leagues and their contents will be removed from the site and registration will begin for the next season.

Fantasy basketball leagues run through August 1. At that time, leagues and their contents will be removed from the site and registration will begin for the next season.

Users are responsible for saving any league information they wish to retain. RTFS is not responsible for retaining data pertaining to a league.

9. Daily Fantasy Games

Daily fantasy games operate continuously, with individual leagues generally lasting between one day and one week.

RTFS will maintain a record of leagues played and their results for a minimum of one year following conclusion of the applicable league.

Participants are individually responsible for retaining any desired information for a longer period.

10. Statistics and Scoring

Scores and statistics are updated as they are received from RTFS's statistics provider. Events outside RTFS's control may delay reporting, and RTFS is not responsible for the timeliness or accuracy of statistics received from its providers.

Because statistics are updated live, errors may occur. Statistical errors are generally corrected by the statistics provider during the sporting event but may take up to 24 hours to correct.

If an error is not corrected by the provider, RTFS will correct the statistic only when it is overwhelmingly obvious that the statistic is erroneous. If doubt exists regarding the validity of the statistic, RTFS will retain the statistic supplied by its provider.

Statistics for a given NFL week are final at noon on Thursday of the following week. Subsequent NFL statistical changes will not be reflected by RTFS.

Statistics for a given MLB week are final at noon on Thursday of the following week. Subsequent MLB statistical changes will not be reflected by RTFS.

RTFS nevertheless reserves the right to change any statistic at any time for an unforeseen reason.

RTFS is not responsible for inaccuracies, representations, statements, graphics, or other content uploaded to its servers or websites by third-party vendors or users, including sports leagues, statistics and data providers, news organizations, members, subscribers, customers, or participants.

11. Refund Policy

11.1 Full-Season Fantasy Football Commissioner Service

Users may receive a full refund through October 1 of the current football season without question.

Refunds are not available after October 1 of the current football season.

11.2 Playoff Fantasy Football Commissioner Service

Users may receive a full refund through January 10 of the current football season without question.

Refunds are not available after January 10 of the current football season.

11.3 Full-Season Public Fantasy Leagues

Refund policies for full-season public fantasy sports leagues are contained in the Official Rules applicable to each game.

11.4 Daily Fantasy Games

Refund policies for daily fantasy games are contained in the Official Rules of RealTime Daily.

11.5 King of the Mountain and King of the Mountain 2

Players may receive a full refund until 24 hours before the first game of the season.

11.6 RTFS Reservation of Rights

RTFS reserves the right to grant a refund at any time and for any reason.

12. Site Credit

RTFS may periodically award site credit as a play incentive or referral incentive. Awarded site credit appears as part of the player's total account balance.

Site credit:

  • is spent after all deposits and winnings in the player's account have been spent;
  • does not expire;
  • may be used toward any purchase, product, service, or contest offered by RTFS;
  • cannot be paid out through direct deposit, paper check, or any other form;
  • cannot be traded or transferred to another player for any reason; and
  • is forfeited if a player requests a refund, violates terms of service, permanently closes the player's account, or at the discretion of RTFS.

13. Taxes and Reporting

Players are entitled to a complete record of their account transactions at any time.

Verified players acknowledge that account activity and winnings may be disclosed to a Secretary of State, Department of Revenue, Gaming Commission, or other applicable state entity having jurisdiction.

Verified players acknowledge that winnings may be reported to the Internal Revenue Service as required by law.

14. Fraud, Collusion, and Contest Integrity

Users shall not engage in fraud, collusion, coordinated play, account sharing, unauthorized automated activity, manipulation of contests or scoring systems, circumvention of entry limits, falsification of identity or location, payment fraud, or conduct intended to obtain an unfair advantage or interfere with contest integrity.

RTFS may investigate suspected violations and may temporarily restrict accounts, entries, withdrawals, or other activity while an investigation is pending.

Where RTFS determines that a violation has occurred, RTFS may take action permitted by these Terms, applicable Official Rules, and applicable law, including disqualification, cancellation of entries, forfeiture where permitted, account suspension, account termination, or referral of suspected unlawful activity to appropriate authorities.

15. Account Suspension and Termination

RTFS reserves the right to terminate service without refund for abusive language, threatening messages, or threatening actions directed toward an RTFS employee, contractor, subcontractor, partner, or other associate. Threat or abuse, whether verbal, physical, electronic, written, or otherwise, may result in immediate termination of service and may result in legal or civil action by RTFS.

RTFS reserves the right to terminate service without refund for malicious conduct directed toward RTFS or resulting in unnecessary activity by RTFS. Such conduct includes intentional acts intended to harm RTFS operations, including hacking, denial-of-service attacks, malicious email or viruses, or intentional harm to RTFS customers, including other members of a player's league.

15.1 Commissioner Services — Failed Payments

A payment check returned for insufficient funds will result in immediate suspension of commissioner service. The league must pay the original non-discounted commissioner service fee plus a $20 overdraft fee to restart service.

A bank payment rejected for insufficient funds will result in immediate suspension of commissioner service. The league must pay the original entry fee or deposit plus a $25 overdraft fee to restart service.

A credit-card chargeback will result in immediate suspension of commissioner service. The league must pay the original non-discounted service fee plus a $30 processing fee to restart service.

15.2 Public Leagues — Full Season and DFS

A bank payment rejected for insufficient funds will result in immediate suspension of access to all teams and funds in the player's account. The player must pay the original entry fee or deposit plus a $25 overdraft fee to resume access.

A credit-card chargeback will result in immediate suspension of access to all teams and funds in the player's account. The player must pay the original entry fee or deposit plus a $30 processing fee to resume access.

Players with outstanding overdrafts or chargebacks shall forfeit all winnings. Outstanding overdraft or processing fees shall be deducted from the player's account balance.

RTFS reserves the right to close a player's account without notice if a deposit or entry fee is charged back or rejected for insufficient funds.

16. Inactive Accounts

RTFS accounts having a positive cash balance that have been inactive, defined as having no purchase or withdrawal, for three years will be assessed a $5 monthly inactivity fee unless prohibited by applicable law. Louisiana players will not be charged an inactivity fee.

An account will automatically reactivate when a purchase or withdrawal occurs.

RTFS will attempt to notify an account holder at least 30 days before the account is declared inactive.

RTFS accounts having a positive cash balance that have been inactive, meaning no purchase or withdrawal, for seven years will be forfeited and permanently closed.

RTFS will attempt to notify the account holder at least 90 days before an account is forfeited.

17. Responsible Gaming

RTFS is committed to promoting responsible participation in fantasy sports and provides players with information, safeguards, and account controls intended to encourage responsible gaming.

17.1 Responsible Gaming Resources

RTFS provides responsible gaming information, resources, and account controls through its Responsible Gaming page. Players are encouraged to review and use these resources as appropriate.

17.2 Age Restrictions and Parental Controls

Persons under eighteen (18) years of age are not permitted to participate in any fantasy contest offered by RTFS that requires an entry fee.

RTFS uses third-party age and address verification services to verify potential participants before permitting entry into paid fantasy contests. Persons determined to be under eighteen (18) years of age are actively prohibited from participating in such contests.

A parent or legal guardian who is concerned that a minor may be attempting to participate in paid RTFS contests may contact RTFS Customer Support at support@rtsports.com or (636) 447-1170. The parent or guardian should provide available account identification information and/or the Internet Protocol ("IP") address associated with the minor. Upon verification that the individual is a minor, RTFS will close the applicable account and/or actively block the device identified by the provided IP address from accessing paid-entry games.

Parents and guardians may also use third-party Internet filtering or parental-control software to restrict access. Examples include OpenDNS, which may be contacted at 1-877-811-2367, and Net Nanny, which may be contacted at 1-800-485-4008.

17.3 Voluntary Self-Exclusion

Verified players may voluntarily self-exclude their RTFS account at any time through the options provided on the RTFS Responsible Gaming page.

Unless different periods are expressly required by applicable state law or regulation, available voluntary self-exclusion periods range from one (1) week through two (2) years.

During a voluntary self-exclusion period:

  • the player will be actively prohibited from joining any fantasy contest; and
  • the treatment, forfeiture, or return of any account balance will be handled in accordance with applicable state laws and regulations.

A voluntary self-exclusion will remain in effect for the selected period and will be administered in accordance with applicable state-specific legal and regulatory requirements.

17.4 Permanent Account Closure

Verified players may elect to permanently close their RTFS account at any time through the options provided on the RTFS Responsible Gaming page.

Permanent account closure is subject to the following provisions:

  • The forfeiture or return of any account balance will be handled in accordance with applicable state laws and regulations.
  • The player will forfeit all unused site credit upon closure of the account.
  • The player will forfeit all active contest entries and any potential prizes associated with those active entries upon closure of the account.
  • A player whose account has been permanently closed will be actively prohibited from joining any RTFS fantasy contest.
  • RTFS will not permit a player whose account has been permanently closed to establish or use a new, replacement, secondary, or other additional account for the purpose of participating in RTFS fantasy contests.

Permanent account closure does not eliminate RTFS's obligation to retain account, transaction, contest, tax, regulatory, or other records in accordance with applicable law, regulation, and the RTFS Privacy Policy.

17.5 Monthly Deposit Limits

Certain states impose monthly deposit limits on fantasy sports participants. RTFS enforces applicable monthly deposit limits for season-long and daily fantasy contests requiring an entry fee when a player is physically located in a state in which such limits apply.

For purposes of these limits, a "deposit" includes:

  • credit card deposits used to purchase entries into fantasy contests;
  • check deposits used to purchase entries into fantasy contests; and
  • direct credit card purchases of fantasy contest entries.

Where permitted by applicable state law or regulation, a player may request an increase to the applicable monthly deposit limit by completing the appropriate Deposit Limit Increase Request Form.

Deposit Limit Increase Request Forms are currently available for:

  • Massachusetts (MA);
  • Maryland (MD); and
  • Tennessee (TN).

RTFS may require proof of assets, income, or other supporting financial information in connection with a request to increase a monthly deposit limit.

Any request to establish or increase a deposit limit is subject to applicable state laws, regulations, eligibility requirements, and RTFS verification procedures.

17.6 Compliance With State Requirements

Responsible gaming requirements may vary by jurisdiction. Where applicable state law or regulation establishes requirements concerning age restrictions, self-exclusion periods, account balances, permanent account closure, deposit limits, or other responsible gaming controls that differ from the general provisions stated above, RTFS will administer the applicable responsible gaming control in accordance with the requirements of that jurisdiction.

Nothing in this Section 17 is intended to limit any responsible gaming protection or player right required by applicable law or regulation.

18. Privacy and Personal Information

RTFS's collection, use, disclosure, security, retention, and destruction of personal information is governed by the RTFS Privacy Policy, which is incorporated into these Terms by reference.

The Privacy Policy describes, among other matters, the categories of personal information collected by RTFS; how that information is used and disclosed; identity, age, and geolocation verification; payment and tax information; data security; data retention; account closure and deletion requests; and secure data destruction.

18.1 Data Retention and Secure Destruction

RTFS may retain account, transaction, contest, identity-verification, tax, security, and related records for periods required by applicable law, regulation, legitimate business requirements, and RTFS data-retention policies.

RTFS retains certain customer account, transaction, contest, and gameplay records for a minimum of seven (7) years in accordance with its established data-retention policies and applicable legal and regulatory requirements.

A request to close an account or delete personal information does not require RTFS to delete information that it is legally or regulatorily required or permitted to retain.

Closing an RTFS account or requesting deletion of personal information does not require RTFS to delete information that RTFS is required or permitted to retain for legal, regulatory, tax, accounting, fraud-prevention, security, dispute-resolution, or other legitimate purposes.

When information reaches the end of its required retention period and is no longer required for a legitimate business, legal, regulatory, or security purpose, RTFS will securely delete or dispose of the information in accordance with applicable RTFS data-security, retention, and destruction policies.

To the extent of any conflict concerning RTFS's handling of personal information, the Privacy Policy shall govern unless applicable law, regulation, or a more specific provision of these Terms imposes a different requirement.

19. Community Forums, Chat, and User Conduct

RTFS administrators and moderators may remove or edit objectionable material. Posts made through RTFS forums and communication services represent the views and opinions of their respective authors and not those of RTFS administrators, moderators, or webmaster.

Users shall not:

  • post commercial solicitations or advertising for products or services without authorization;
  • use a name, nickname, or team name containing abusive, obscene, vulgar, slanderous, hateful, threatening, sexually oriented, or otherwise prohibited terms;
  • post personal attacks or abusive, obscene, vulgar, slanderous, hateful, threatening, sexually oriented, gratuitous, unlawful, or otherwise prohibited material; or
  • use RTFS communications or Services in violation of applicable law.

RTFS reserves the right to immediately and permanently ban offenders and, when appropriate, contact a user's service provider or law-enforcement authorities. IP addresses associated with posts may be recorded to assist in enforcement.

RTFS webmasters, administrators, and moderators may remove, edit, move, or close any topic when they determine it appropriate.

Personal information entered through the Services may be stored in RTFS databases subject to RTFS privacy and security practices.

20. Commercial Use Restrictions

The RTFS platform and Services may not be rebranded, resold, or remarketed for any commercial purpose without the express written permission of RealTime Fantasy Sports.

No third party may represent, advertise, or promote RTFS's platform or Services as operating that third party's services without RTFS's express written permission.

No unlicensed or unauthorized third party may operate paid fantasy contests using the RTFS platform.

The RTFS platform and Services may not be used to operate licensed or unlicensed public fantasy contests in any jurisdiction, including online and in-person public fantasy events.

RTFS reserves the right to terminate current and future access to its Services for any person or entity operating licensed or unlicensed public fantasy contests.

RTFS is not responsible or liable for consequences arising from persons or entities operating fantasy contests using the RTFS platform and Services, and such persons and entities agree to hold RTFS harmless from such consequences.

21. Copyright, Trademarks, Intellectual Property, and Content

21.1 RTFS Content and Copyright

All pages, data, content, materials, graphics, text, statistics, articles, software interfaces, and other materials displayed or made available through RealTime Fantasy Sports ("RTFS") websites and Services are copyrighted by RealTime Fantasy Sports, Inc., except where otherwise expressly identified.

RTFS copyrighted materials may not be copied, reproduced, republished, distributed, transmitted, displayed, reused, or otherwise exploited in any form without the prior express written consent of RealTime Fantasy Sports, Inc.

All fantasy content, statistics, and articles provided by RTFS are the property of RealTime Fantasy Sports, Inc. and are provided solely for private use through the RTFS Services. The resale, redistribution, republication, or other commercial use of such content or Services, in whole or in part and in any form, is strictly prohibited without the written and signed consent of RealTime Fantasy Sports, Inc.

21.2 Intellectual Property

The RTFS websites, applications, software, databases, graphics, designs, interfaces, text, contest formats, scoring systems, trademarks, service marks, logos, and other content created or provided by RTFS are owned by or licensed to RTFS and are protected by applicable intellectual property laws.

Except as expressly permitted by RTFS, users may not copy, reproduce, modify, distribute, publish, display, transmit, sell, license, reverse engineer, create derivative works from, or commercially exploit RTFS proprietary content or technology.

Nothing in these Terms transfers any ownership interest in RTFS intellectual property to a user.

Third-party names, trademarks, statistics, photographs, logos, and other intellectual property appearing through the Services remain the property of their respective owners.

21.3 Application Programming Interfaces (APIs)

Prior express written consent from RTFS is required to access or use any RTFS application programming interface ("API") for any purpose.

No user or third party may access, query, integrate with, reproduce data from, redistribute information obtained through, or otherwise use an RTFS API without RTFS's prior express written authorization.

Any authorized API access remains subject to the terms, restrictions, technical requirements, and limitations established by RTFS for that access.

21.4 User-Submitted Content

RTFS Services may permit users to submit, upload, or display information or materials, including message board comments, league news, league names, team names, league or team logos, messages, posts, images, comments, and other content ("User Content").

Users retain any ownership rights they possess in their User Content. By submitting User Content through the Services, a user grants RTFS a non-exclusive, royalty-free license to host, store, reproduce, display, transmit, and otherwise use that content to the extent reasonably necessary to operate, administer, promote, and provide the applicable RTFS Services.

Users are solely responsible for User Content they submit and represent that they possess all rights and permissions necessary to submit or upload that content and permit RTFS to use it.

Users shall not submit content that is unlawful, defamatory, fraudulent, threatening, infringing, obscene, malicious, or that violates the privacy, publicity, intellectual property, or other legal rights of another person or entity.

RTFS may remove or restrict User Content that RTFS reasonably determines violates these Terms, applicable law, or RTFS policies.

21.5 Prohibited Content

Users, members, subscribers, and participants shall not upload, post, submit, transmit, or otherwise make available through RTFS servers, websites, applications, or communication channels any material that:

  • infringes or violates any copyright, trademark, trade name, service mark, or other intellectual property right;
  • constitutes an unauthorized use of the name, image, likeness, or other protected rights of another person or entity;
  • contains defamatory or libelous statements;
  • is unlawful, harmful, threatening, abusive, obscene, or harassing; or
  • otherwise violates these Terms or applicable law.

RTFS is not responsible for trademark, trade name, service mark, copyright, or other infringement resulting from words, phrases, names, images, comments, or other materials submitted or uploaded by individuals or entities to RTFS servers.

RTFS is likewise not responsible for defamatory or libelous statements contained in materials submitted or uploaded by users or other third parties.

21.6 Commercial Promotions and Advertising

Users may not use RTFS websites, servers, applications, message boards, communication channels, or other Services to advertise or promote commercial products or services, or to encourage others to do so, without the prior express written permission of RTFS.

Persons or organizations wishing to advertise products or services through RTFS may contact RTFS regarding advertising opportunities and rates.

21.7 Professional Sports Organizations and Players

RTFS is an independent fantasy sports provider. References to professional sports leagues, organizations, teams, players, drivers, golfers, statistics, or related information do not imply sponsorship, affiliation, authorization, or endorsement.

Specifically:

  • RTFS is not affiliated with or endorsed by the National Football League ("NFL"), its franchisees, or its subsidiaries.
  • RTFS is not affiliated with or endorsed by the NFL Players Association, Inc. ("NFLPA") or any active or retired NFL player.
  • RTFS is not affiliated with or endorsed by Major League Baseball ("MLB"), its franchisees, or its subsidiaries.
  • RTFS is not affiliated with or endorsed by the Major League Baseball Players Association ("MLBPA") or any active or retired MLB player.
  • RTFS is not affiliated with or endorsed by the National Basketball Association ("NBA"), its franchisees, or its subsidiaries.
  • RTFS is not affiliated with or endorsed by the National Basketball Players Association ("NBPA") or any active or retired NBA player.
  • RTFS is not affiliated with or endorsed by the National Hockey League ("NHL"), its franchisees, or its subsidiaries.
  • RTFS is not affiliated with or endorsed by the National Hockey League Players' Association ("NHLPA") or any active or retired NHL player.
  • RTFS is not affiliated with or endorsed by NASCAR, its franchisees, or its subsidiaries.
  • RTFS is not affiliated with or endorsed by any active or retired NASCAR driver.
  • RTFS is not affiliated with or endorsed by the PGA, USGA, the Masters, or any active or retired professional golfer.

All third-party names, trademarks, service marks, league names, team names, player names, and other intellectual property referenced through the Services remain the property of their respective owners.

22. Copyright and Intellectual Property Complaints

RTFS respects the intellectual property rights of others.

A person who believes that content available through an RTFS Service infringes that person's copyright or other intellectual property rights may contact RTFS and provide sufficient information to identify the protected work, the allegedly infringing material, its location within the Services, and the complaining party's contact information.

RTFS may remove or restrict access to material when appropriate and may take action against accounts that repeatedly violate intellectual property rights.

Nothing in this section limits any rights or procedures available under applicable copyright or intellectual property law.

23. Contributors, Employment, and Representation

23.1 Contributor Status and Attribution

No person may represent or claim that the person is or has been a contributor to any RealTime Fantasy Sports website, publication, Service, or other RTFS property without the prior express written permission of RealTime Fantasy Sports, Inc.

Any public attribution, representation, biography, credential, or other statement identifying a person as an RTFS contributor requires RTFS's prior express written authorization.

23.2 Employment Representations

No person may falsely represent or claim current, prospective, or former employment with RealTime Fantasy Sports, Inc.

No person may represent that the person is an employee, officer, director, representative, contractor, recruiter, agent, or other authorized representative of RTFS unless that person has been duly authorized by RTFS to act in that capacity.

No person or entity is authorized to act as a third-party agent or representative of RealTime Fantasy Sports without the prior express written permission of RTFS.

23.3 Impersonation

Impersonation of an RTFS employee, officer, director, board member, or other authorized representative is strictly prohibited.

RTFS reserves the right to pursue all available remedies against any person who falsely impersonates an RTFS employee, officer, director, board member, or authorized representative, including appropriate civil remedies and referral to law enforcement or other governmental authorities where the conduct may constitute a violation of applicable law.

Nothing in this section limits RTFS's ability to pursue any other remedy available under these Terms or applicable law.

24. Service Availability and Modifications

RTFS endeavors to provide reliable and continuous access to the Services but does not guarantee that the Services will be available without interruption, delay, error, or technical failure.

The Services may be temporarily unavailable or impaired due to scheduled maintenance, emergency maintenance, Internet or telecommunications failures, hosting or infrastructure failures, third-party service failures, software or hardware defects, cybersecurity events, natural disasters, governmental actions, or other circumstances beyond the reasonable control of RTFS.

RTFS may modify, update, suspend, restrict, or discontinue any portion of the Services when reasonably necessary for maintenance, security, legal or regulatory compliance, technological changes, operational requirements, or other legitimate business purposes.

Nothing in this section permits RTFS to modify the material terms, scoring, prizes, or results of an existing contest except as permitted by the applicable Official Rules, these Terms, or applicable law or regulation.

25. Third-Party Services and Information

RTFS may rely upon third parties to provide portions of the Services or information used in connection with the Services. Such third parties may include payment processors, financial institutions, identity verification providers, geolocation providers, statistics and data providers, hosting providers, telecommunications providers, and other technology or service providers.

RTFS is not responsible for interruptions, delays, inaccuracies, or failures caused by third-party services or information except to the extent responsibility cannot lawfully be excluded or as otherwise expressly provided in these Terms or applicable Official Rules.

The use of third-party providers does not modify RTFS's obligations regarding player funds, contest administration, privacy, data security, regulatory compliance, or other obligations expressly imposed upon RTFS by applicable law or regulation.

26. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE RTFS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

RTFS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM DELAYS, DEFECTS, OR TECHNICAL FAILURES.

RTFS DOES NOT WARRANT THE CONTINUOUS AVAILABILITY OR ACCURACY OF INFORMATION PROVIDED BY THIRD-PARTY STATISTICS, DATA, COMMUNICATIONS, PAYMENT, GEOLOCATION, IDENTITY VERIFICATION, OR OTHER SERVICE PROVIDERS.

Nothing in this section modifies RTFS's obligations to administer contests, award prizes, maintain player funds, correct scoring or statistical issues where required, or otherwise perform obligations expressly established by applicable Official Rules, these Terms, or applicable law or regulation.

Nothing in these Terms excludes any warranty or protection that cannot lawfully be excluded.

27. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RTFS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO ACCESS TO OR USE OF THE SERVICES.

This limitation includes, where permitted by law, damages arising from loss of use, loss of data, interruption of service, unauthorized access resulting from circumstances outside RTFS's reasonable control, or failure of third-party services.

Nothing in this section limits RTFS's responsibility for account balances, authorized withdrawals, refunds, prizes, or other amounts properly owed to a user under these Terms or applicable Official Rules.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

28. Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold harmless RTFS and its officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs and expenses, including reasonable attorneys' fees, arising from:

  • the user's material violation of these Terms or applicable Official Rules;
  • the user's violation of applicable law;
  • fraud or intentional misconduct by the user;
  • User Content submitted by the user;
  • infringement or alleged infringement of another person's intellectual property, privacy, publicity, or other legal rights by User Content submitted by the user; or
  • unauthorized use of the Services through the user's account resulting from the user's failure to reasonably protect account credentials.

This section does not require a user to indemnify RTFS for claims resulting from RTFS's own negligence, willful misconduct, or violation of applicable law to the extent such indemnification is prohibited by law.

29. Force Majeure

RTFS shall not be responsible for delay or failure to perform an obligation when performance is prevented by circumstances beyond RTFS's reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, civil disturbance, governmental action, widespread Internet or telecommunications failure, widespread power failure, labor disruption, cybersecurity incidents affecting third-party infrastructure, or failure of critical third-party services.

RTFS will use commercially reasonable efforts to restore affected Services and fulfill outstanding obligations when reasonably practicable.

This provision does not relieve RTFS of obligations that applicable law or regulation does not permit RTFS to disclaim.

30. Changes to These Terms

RTFS may modify these Terms from time to time to reflect changes in the Services, business practices, technology, security requirements, applicable laws or regulations, or other operational requirements.

When RTFS makes material changes to these Terms, RTFS will provide notice as appropriate under the circumstances and applicable law. The revised Terms will identify their effective date.

Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Changes to these Terms will not retroactively modify the material rules, entry requirements, scoring, or prize structure of an existing paid contest except as permitted by the applicable Official Rules or required by applicable law or regulation.

31. Electronic Communications

By creating an RTFS account or using the Services, users consent to receive account-related communications electronically, including communications concerning account activity, transactions, contests, security, verification, changes to the Services, and changes to applicable agreements or policies.

Where permitted by applicable law, electronic notices provided through the RTFS website, application, account interface, or email address associated with a user's account satisfy requirements that such communications be provided in writing.

Users are responsible for maintaining a current and valid email address and other required contact information associated with their RTFS account.

Consent to receive necessary account and legal communications is separate from consent to receive promotional marketing communications. Users may opt out of promotional email communications as provided in the RTFS Privacy Policy.

32. Disputes and Jurisdiction

Any dispute concerning an RTFS account, transaction, contest, prize, or use of the Services should first be presented to RTFS customer support so that RTFS has a reasonable opportunity to investigate and resolve the matter.

Contest-related disputes remain subject to the applicable Official Rules and any dispute or appeal procedures required by the jurisdiction governing the contest.

Where applicable law or regulation grants a state regulatory agency or other governmental authority jurisdiction over a fantasy sports dispute, nothing in these Terms limits the participant's rights before that authority.

Nothing in these Terms requires a user to waive a right or remedy that cannot lawfully be waived.

33. Severability

If any provision of these Terms is determined by a court, regulatory authority, or other tribunal of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be interpreted or enforced to the maximum extent permitted by law.

If the provision cannot be so interpreted or enforced, it shall be severed to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

34. No Waiver

Failure by RTFS to enforce any provision of these Terms in a particular instance shall not constitute a waiver of that provision or RTFS's right to enforce the provision in another instance.

Any waiver by RTFS must be expressly authorized and applies only to the specific circumstances for which it is given.

35. Assignment

Users may not assign or transfer their RTFS accounts or their rights or obligations under these Terms without the prior written consent of RTFS.

RTFS may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, corporate reorganization, sale of substantially all applicable assets, or other lawful business transaction, subject to applicable legal and regulatory requirements.

36. Entire Agreement

These Terms, together with the RTFS Privacy Policy, applicable Official Rules, scoring rules, responsible gaming requirements, and any other policies or terms expressly incorporated by reference, constitute the agreement governing the user's use of the applicable RTFS Services.

Contest-specific Official Rules remain controlling with respect to the eligibility, operation, entry requirements, scoring, prizes, settlement, and other specific terms of the applicable contest where those provisions differ from general provisions contained in these Terms.

Nothing in this section supersedes or limits requirements imposed by applicable law, regulation, or regulatory authority.

37. Headings and Interpretation

Section headings are provided solely for convenience and organization and do not limit or otherwise affect the interpretation of these Terms.

References to "including" or "includes" mean "including without limitation" unless the context clearly requires otherwise.

References to applicable law include applicable statutes, regulations, rules, orders, and legally binding regulatory requirements.

38. Contact Information

Questions regarding these Terms, an RTFS account, a transaction, or an RTFS contest may be submitted through the customer support and contact methods provided on the RTFS website.

Privacy-related questions and requests are governed by and should be submitted in accordance with the RTFS Privacy Policy.

Regulatory complaints or inquiries may also be submitted to the applicable governmental or regulatory authority where such rights are provided by applicable law.

39. Effective Date and Acceptance

These Terms of Service are effective as of August 19, 2026 and supersede prior versions of the RTFS Terms of Use or Terms of Service as of the effective date, except to the extent a prior version remains applicable to a particular transaction, contest, dispute, or other matter under applicable law or the applicable Official Rules.

By creating an RTFS account, accessing or using the Services, or entering an RTFS contest after these Terms become effective, the user acknowledges and agrees to these Terms to the extent permitted by applicable law.
